Types of inheritances in argentina
There are basically two different kinds of probate proceedings in Argentine: intestate successions, meaning successions in absence of a will (sucesiones ab intestato), and testamentary successions.
Intestate succession If a person dies leaving no will (intestate succession) Argentine law determines who will inherit the estate, and how it will be distributed, in case of plurality of heirs. Also called ab intestato sucession.
Testamentary succession You can make a will in favor of another person, but the ¨porción legítima¨(legal portion) will always be respected. This means that this portion can not be freely disposed of and will be distributed among the relatives in a straight line and the spouse. If the person has no heirs, the state is considered vacant and, as such, all assets will be transferred to the Provincial State. This type of sucession is called "Vacant sucession"
